How is User information used?

Websites.com is owned by NTT Communications, Inc., and operated by the NTT Communications Group (collectively, “NTT”). Websites.com may share User information with NTT subsidiaries and selected partners, for example, to provide Users with information about products which might be of interest to the User or to enable the User to take advantage of special partner programs. Websites.com may also use User information to provide its Users with system information or information about new or upgraded products.

When a User visits Websites.com, Websites.com may send such User’s computer a cookie to identify such User’s browser. Cookies allow Websites.com to track and compile a User’s browsing habits on the Site. Websites.com uses cookies for such functions as verifying whether a User is a Registered User and tracking such User’s visits to the Site. Websites.com further uses cookies to determine the number of Users that visit the Site. A User’s cookie number is also used to create usage paths and to correlate those with any demographic information such User provides, but Websites.com does not use such cookies or usage paths to attempt to determine a User’s identity. Websites.com may also use technology such as pixel tags (also known as clear gifs) and web beacons in connection with e-mails Websites.com may send a User (provided such User consents to receive emails) to allow Websites.com to determine if such User opened the email. Websites.com also may use such technology to track a User’s browsing habits on the Site. Websites.com uses technology, including pixel tags and web beacons, to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. Websites.com may use technology, including pixel tags and web beacons, to serve specific advertisements to a User on the Site based on such User’s browsing habits which were tracked by the technology. The information collected through pixel tags is not personally identifiable.

In the case of a business transaction, including but not limited to, a merger or sale of a portion of Websites.com's assets, User information will likely be part of the assets transferred. In this event, Websites.com will attempt to notify impacted Users that their information has been transferred. In order to receive these notifications, as well as notifications that the Privacy Policy has changed, you must register with Websites.com.

Opt Out & Modifications

Registered Users may opt out of receiving notices of new or upgraded products from Websites.com and Websites.com partners by modifying their registration. However, Registered Users may not opt out of receiving information from Websites.com which is essential for maintaining or updating customers' accounts or system information.
Most browsers allow you to disable cookies (i.e., not allow Websites.com’s servers to send Cookies to your browser); however, some of Websites.com’s services may not function properly if you disable cookies.

Disclosure of Customer Information and Communications

Websites.com will not otherwise disclose its Users' personal and account information unless Websites.com has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of Websites.com, Websites.com’s Users, NTT, its subsidiaries or partners, or others, or where Websites.com has a good faith belief that the law requires such disclosure.

Websites.com also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that Websites.com stores or receives from its Users. The circumstances under which Websites.com will disclose such electronic User communications are when:

1. it is necessary in order to provide service to the User;

2. it is necessary to protect the legitimate interests of Websites.com and its Users;

3. it is required to cooperate with interception orders, warrants, or other legal process that Websites.com determines in its sole discretion to be valid and enforceable; and

4. it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Websites.com and appear to pertain to the commission of a crime.

Websites.com disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by Users or others. Websites.com will, however, review, delete or block access to communications that may harm Websites.com, its Users or third parties. The grounds on which Websites.com may take such action include, but are not limited to, actual or potential violations of Websites.com's Acceptable Use Policy.
